October 10, 2020 Update: Funds Distribution!!

All removal of entrance monuments have been completed. The final HOA Board is in the progress of distribution of the remaining funds. You will be contacted by Terry Linville to receive a check from the HOA. The final totals are outlined in the breakdown below. All remaining funds (total: $32,952.26) will be divided equally among all current lot owerss whose dues are up-to-date. All lot owners who have delinquent dues and/or outstanding monies owned, will have that amount applied to their account prior to the remaining funds being divided.

April 5, 2020 Update

The final Board would like to give everyone an update on where we are with completion of dissolution.

Dissolution was completed at the end of 2019. The Bonney Lake Manor HOA CC&Rs were amended to remove the architectural review committee (ARC), the Board as a governing body and quit claim deeds were filed on lots 1, 36 and 74 giving that property back to the owners. The owners of those lots will be contacted directly with our plans for removal of the entrance monuments.

Remaining Work – Currently on Hold

There are three orders of business left to be completed by the board at this time (in this order):

  1. Removal of entrance monuments
  2. Permission letters for releasing of liens
  3. Distribution of remaining HOA funds after the above tasks have been completed

Unfortunately because of the COVID-19 outbreak further work is considered ‘non-essential’ by the Governor and we simply cannot get contractors to come out and either render estimates or begin work on removal of the monuments. As soon as we’re able to complete the first phase we will be quickly completing the remaining work.

Release of Liens

If a lien was filed against your property and/or a garnishment of wages for failure to pay dues to the Association you can expect the following to occur and be sent to you:

  • You will receive a letter giving you permission to file a release of the lien at your expense.
  • We will work with the attorneys to file a removal of any wage garnishments.
  • Due to the failure to pay dues and the legal fees incurred by the prior Board to collect, you will not be entitled to any distribution HOA funds.

Adherence to remaining CC&Rs

This was stated in a prior update, but it bears repeating: Please remember that while the governing body no longer will exist, the CC&Rs are not being completely vacated. They are a contract and covenant with the City of Bonney Lake that was part of the agreement to create Bonney Lake Manor filed with the City of Bonney Lake and Pierce County. They are part of the legal documentation that facilitated approval of the permitting for Bonney Lake Manor to be created. While the governing enforcement body (the HOA Board) will no longer exist, those regulations will always be in place as long as these plats exist.

This means that, as homeowners everyone in this community is still expected to abide by all CC&Rs and architectural addendums (such as fence construction materials and location). You can still be civilly held accountable by the community to adhere to those. All a homeowner in the community would have to do is contact a real estate lawyer, file the paperwork and have you served for failure to comply. You would then have to appear before a judge and the judge can order you to comply. The lack of existence of the HOA does not preclude that from happening. As members of the community we still have a duty and an obligation to ourselves and our neighbors to make our community the best that it can be.

2019 Seal Coat Project : Starting August 27th

The following information is provided to you regarding a construction project that will begin on August 19, 2019. The areas that will be impacted by us will be worked on August 27th and August 29th. The City of Bonney Lake will be applying a seal coat to the following street locations within our community.

  • 111th St E, including the cul de sacs.
  • 109th St Ct E

All of this will be done on the west side of 192nd Ave E facing Fennel Ridge.

When seal coat is applied the City’s contractor Northwest Traffic, Inc. will need to prevent vehicles from driving on the street until the seal coat cures. During this time there will be designated areas for residents to park and Northwest Traffic, Inc. will provide that information the day of the seal coat application. Northwest Traffic, Inc. will also notify residents by door hanger twenty four hours before seal coating the street.

We will make every effort to complete this job in a timely manner and to minimize delays to your use of the street. Please drive slowly and avoid sharp turns on the fresh seal coat once the street has been reopened.

BONNEY LAKE MANOR HOME OWNERS ASSOCIATION 6/08/19 BOARD MEETING & 6/20/19 SPECIAL MEETING

6/08/19 BOARD MEETING

The 2nd quarter board meeting was called to order at 0813

All board members were in attendance. Homeowners Mike and Tammy Flores were in attendance as well.

Terry shared the financial report and it was approved.

The current state of the resolution was discussed. The board plans to do more doorbelling to ensure that all homes were notified, had a ballot and had the opportunity to make a vote.

6/20/19 SPECIAL MEETING

A special resolution meeting of the Board was held to count ballots and document the total number of votes.

The meeting was called to order at 1839. All board members were present. Resolution 2019 passed with 62 YES votes, 20 NO votes and 9 ballots NOT RETURNED.

The board will continue with the resolution process as outlined in the Resolution 2019 document mailed out in the Spring Newsletter. There will be a final mail out at the conclusion of the resolution process. The website will remain active with updates of the progress.

Resolution 2019-01 – Resolution to Dissolve the Bonney Lake Manor Homeowners Association

Article 8 of the Articles of Incorporation of Bonney Lake Manor Homeowners Association

Dissolution.  The Association may be dissolved only upon a resolution duly adopted by the Board of Directors and the affirmative vote of members who are Owners of not less than two-thirds (2/3) of the Lots. (It takes 61 affirmative votes to pass a resolution)

The Board of Directors have unanimously voted to duly adopt this resolution, and request that the Owners vote, to decide if the Bonney Lake Manor Homeowners Association shall be Dissolved.  

What this would mean if passed:

No more dues would be collected, and the funds in the accounts would be used for the Dissolution of the Association.

The signage at both the north and south entrances would be removed along with electric service and sprinkler controls at the southwest sign.  The existing landscaping would be removed if the homeowners of the affected lots requested it, and the easements would be landscaped to match as closely as feasible the surrounding area. The easements for signage on these lots would be vacated and the Owners would no longer be required to provide access to the easement.

  • The lawn care service would be terminated.
  • The attorney would be notified of the dissolution.
  • The website would be dismantled; the Facebook page may likely remain.
  • Each homeowner would receive the folder for correspondence for their lot. 
  • The insurance policy would be cancelled.
  • The Post Office Box would be vacated.
  • A final tax return would be filed for 2019 in 2020.

After the dissolution process is completed. All remaining funds would be divided equally among all Owners whose dues are current. Any owners who have delinquent dues and/or outstanding monies owed, would have that amount applied to their account prior to the remaining funds being divided. If any homeowner has a lien against their property for non-payment of dues, late fees, or fines to the HOA, it will be their responsibility to pay the costs to have the lien removed, if their share of the remaining funds do not cover these costs.

Official Ballots will be mailed out the week of May 13, 2019 and must be returned no later than June 15, 2019 to be counted.

Parking Changes on 193rd in Bonney Lake Manor

This week all residents in Bonney Lake Manor with homes along 193rd and the connecting streets should have received letters from the City of Bonney Lake regarding changes to the street-level and curbside parking along 193rd and the connecting streets of 109th, 110th, 111th, 112th and 113th.

In the last couple of years the board has deal with multiple parking abuse issues. These have included:

  • Former residents having cars on their property and surrounding streets far exceeding what would reasonably be expected as acceptable by community standards and impeding other residential traffic (one resident at one point had 20 cars parked along 193rd).
  • Residents either parking in the yards of neighboring residents or allowing guests to park in said yards.
  • High school students using 193rd and adjoining streets as ‘overflow parking’ for Bonney Lake High School.

After consulting with the City of Bonney Lake on these issues (and with at least one of the situations requiring involvement of local law enforcement) the City of Bonney Lake are enacting parking restrictions on 193rd and the adjoining streets. Signs have started being posted as of the last week of February 2019. Everyone should have gotten a copy of the letter from the City. We’ve also included a copy of the letter here for Bonney Lake Manor residents.

What this means to residents in Bonney Lake Manor:

In short the following changes will occur:

From 7:00 AM to 3:00 PM only residents of Bonney Lake manor and their guests can park on the streets in the right-of-way on 193rd and the adjoining streets.

If you only park in your driveway or designated parking areas, nothing changes for you. You can continue to do so. The only exception would be if the parking area is in the right of way which means the vehicle would require a permit.

If you use the street for parking, you will be required to get a free parking permit for your car from the City of Bonney Lake. Permits can be obtained by mail or at the Bonney Lake Justice Center. Details for what is required for proof are included in the letter you can download from here.

Guests will be required to have a guest permit hanging in their car if they are parking during restricted zone hours. Each resident can have one guest permit per resident. Again, details for what is required for proof are included in the letter you can download from here.

Dues, Annual Homeowners Association Meeting

The annual Homeowners association meeting will be Feb 27, 2019 at 7:00 PM.  It will be held at the Mountain View Middle School, in the Commons.  Hope to see you all there.

Dues: Annual Association dues for the year 2019 will be $25.00 and are due January 1, 2019.  The reduced rate is to allow homeowners to purchase a locking mailbox if they choose to.  They will be considered late if received after the Homeowners meeting where a late fee of $25.00 will be added.

To make your payment you can:

  • Drop payment in the BLMHOA mailbox on the corner of 193rd Ave E and 110th ST E,
  • Bring payment to the annual Association Meeting.

Mailbox Update!!

I’m sure you have all seen by now that yes the mailbox stands are being updated! Construction crews are coming out and getting to work right now!

  • Currently they have gone to each of the areas where a stand is and marked it with white paint where the new stand will be. Basically as a rectangle to show the area that the new one will fill.
  • The construction company will also be calling 811 to do the “call before you dig” check up to make sure nothing will be affected.
  • The board will be reviewing each location to make sure the new location/layout will be acceptable and inform them if we find otherwise.  If you see something or have questions be sure to contact us via hoaboard at bonneylakemanor.com or via the contact form at https://www.bonneylakemanor.com/contact/ .
  • Right now you’ll notice that mailboxes have also been moved and set up the so that the carriers can still have access to them while they work.

If you have the previously Board-approved style of locking mailbox you will have to remove it from the old stand and relocate it to the new stand on your own.  These are bolted to the old stand from inside the box and the construction company will not be able to move it for you.

The new approved mailbox is the Oasis 360 from Architectural Mailboxes. You can order them from Lowe’s, but they are also a regularly stocked item.
